West Virginia Vending Machine Permits and Licenses
Vending permits and licenses by state · West Virginia
We found no general state license for vending machines in West Virginia. Most operators need one thing from the state: a $30 business registration certificate from the Tax Division, which also serves as your sales tax certificate. Food is where West Virginia differs. It charges no state sales tax on most groceries, but food, candy and soft drinks sold from a vending machine pay the full 6%. Below is each requirement and the law it comes from.

Do you need a license to run a vending machine in West Virginia?
Not a vending license. We found none at the state level. Every business needs a business registration certificate from the Tax Division before it starts (W. Va. Code 11-12-3), and for most operators that is the one state license that matters. The Tax Division's business registration page lists the businesses with extra registration rules, such as collection agencies, telemarketers and transient vendors. Vending is not on it.
If a machine sells food that needs temperature control, add a local health department permit. Cities can add a business license or a gross receipts tax, so check with the city where each machine will sit.
Out-of-state operators and the transient vendor rule
A transient vendor brings taxable goods into West Virginia to sell to consumers and keeps no established office, warehouse, residence or other place of business in the state (W. Va. Code 11-12-20). It files Form TVL-1, pays the $30 registration tax, posts a $500 bond and tells the Tax Commissioner in writing where and when it will do business (W. Va. Code 11-12-21; Tax Division). The law does not say whether a vending machine on someone else's property is a place of business. If you live out of state and stock machines here, ask the Tax Division whether these rules apply to you.
Sales tax on vending sales in West Virginia
The business registration certificate
West Virginia has no separate sales tax permit. Registering the business with the Tax Division also opens your sales and use tax account (TSD-100), and the Tax Division's sales tax FAQ says "your Business Registration certificate can also be considered as your sales certificate."
- Cost: $30 (TSD-360). It is permanent until the business closes, moves, changes its legal name or changes owners (Tax Division; W. Va. Code 11-12-5).
- Where to apply: the Business for West Virginia portal, or Form WV/BUS-APP.
- Coverage: you need a certificate for each fixed business location. The law adds that one "is not required for each coin-operated machine," but is required "for each location from which making coin-operated machines available to the public is itself a business activity" (W. Va. Code 11-12-3(b)). It does not say how that applies to machines in other people's businesses, or define coin-operated, which matters for card-only machines. Ask the Tax Division in writing whether you need one certificate or one per site.
- Who owes the tax: the person who controls the machine, "the one who has the key, fills the machine" (TSD-405).
You collect the tax, so buy your inventory tax-free
The sales tax on vending sales is yours to collect and send to the state. That is why you should not also pay sales tax when you buy the inventory. West Virginia exempts "sales of tangible personal property to a person for the purpose of resale," claimed with an exemption certificate (W. Va. Code 11-15-9(a)(9)).
- Form F0003, Streamlined Sales and Use Tax Certificate of Exemption: the form the Tax Division points buyers to. Check reason G, Resale, enter WV and your registration number, give it to the supplier and keep a copy. You must hold a valid business registration certificate to use it. Download Form F0003 (PDF) and the instructions.
- Blanket certificates: allowed. Leave the single-purchase box unchecked and one certificate covers ongoing purchases from that supplier, as long as no more than 12 months pass between purchases (W. Va. Code 11-15B-24(f)).
- Out-of-state suppliers: West Virginia is a full Streamlined member, and F0003 is the Streamlined form. We found no Tax Division guidance on the Multistate Tax Commission's Uniform certificate,. Use F0003.
The certificate covers products you resell, not the machines you sell them from. If you buy items tax-free and later use them yourself or give them away, you owe tax on the purchase price, as the F0003 instructions say (W. Va. Code 11-15A-2). The Tax Division's retailer example in TSD-345 pays use tax on "groceries I took home for my own personal use." Report it on your sales and use tax return (TSD-369).
Sales tax rates
The state rate is 6% (W. Va. Code 11-15-3). A municipality can add up to 1% on the same items (W. Va. Code 8-13C-4). On the Tax Division's list issued October 22, 2026, 101 municipalities charge 1% today and six more start January 1, 2027. Every rate on the list is 1%, for a 7% combined rate.
- Where it applies: the municipal tax covers goods "provided within the boundaries of the taxing municipality" (municipal sales tax page), so use the rate for the town where each machine sits. Report it on the municipal schedules of your state return.
- Special districts: in a few districts, such as University Town Center in Monongalia County, a special district excise tax replaces the state sales tax and has its own return (Tax Division).
How vending sales are taxed in West Virginia
West Virginia stopped taxing most food after June 30, 2013 (W. Va. Code 11-15-3a). Vending is the exception. The law keeps "food sold through vending machines" and "soft drinks" at the general 6% rate (W. Va. Code 11-15-3b).
- What counts: "food dispensed from a machine or other mechanical device that accepts payment" (W. Va. Code 11-15B-2(b)(24)). Nothing in it requires coins, so card-only machines are covered too.
- Snacks, candy and bottled water: no state tax on a grocery shelf, 6% from your machine.
- Soft drinks: 6% wherever they are sold. The separate soft drink excise tax, one cent per 16.9 ounces, was repealed effective July 1, 2024 (W. Va. Code 11-19-13).
- Tax-included prices: divide what a machine took in by 1.06, then multiply by .06, adding the municipal rate where it applies (TSD-405). In its example, $1,000 in receipts holds $56.60 of state tax. Machine sales are added together for the calculation, not taxed one vend at a time (W. Va. Code 11-15-3(e)).
- Posted notice: the state's sales tax rule calls for a sign, readable from 20 feet, wherever items are sold with the tax included (110CSR15, sec. 4.6.1.2). TSD-405 does not mention one for machines, so ask the Tax Division.
- Everything else: trading cards, sealed Pokémon product, mystery items, toys and general merchandise pay the full state and municipal rate.
Food and drinks: when you need a health department permit
The Bureau for Public Health's food establishment rule, 64CSR17, counts a "vending location" as a food establishment and adopts the 2013 FDA Food Code. The permit comes from your local health department, not the state. The Office of Environmental Health Services says "permitting and inspecting Food Service Establishments in West Virginia is the responsibility of the Local Health Departments" (OEHS food safety page).
- No permit: the rule leaves out "an establishment that offers only prepackaged foods that are not time/temperature control for safety food" (64CSR17, sec. 4.3.a). Sealed snacks, candy and canned or bottled drinks generally fit.
- Permit: sandwiches, salads, milk, or anything that has to stay cold or hot to stay safe.
- Fees: each local board of health sets its own permit fees (W. Va. Code 16-2-11). The old statewide fee rule, 64CSR30, was repealed in 2024. For example, the Monongalia County Health Department requires a permit for "all vending machines that have foods which require temperature control for safety," and its 2026 to 2027 fee schedule charges $72 per machine, up to $432 per site.
A proposed update to 64CSR17, filed in 2026, would move the rule to the 2022 FDA Food Code and keeps the prepackaged food exclusion. As of this review it is a proposed rule, not yet in effect.
Machines that sell only trading cards, toys or other merchandise do not sell food, so the health permit does not apply to them.
West Virginia rules for trading cards, mystery products and toys
Pokémon and other trading cards
West Virginia has no special license for selling trading cards. They are taxable merchandise, so the business registration certificate covers you. The legal questions with card machines are about intellectual property, not state permits: stock authentic product, and keep Pokémon characters and logos off the machine itself. Our guide to the legal side of trading card vending machines covers both, and the Pokémon vending machine guide covers the business.
Mystery products and toys
Blind boxes, mystery bags and capsule toys are merchandise. Like trading cards and toys, they are taxable at the full state and municipal rate, so the business registration certificate covers them. We found no special license for selling them from a vending machine. See our guide to mystery vending machines.
Claw and crane machines
We found no state license for claw or crane machines.
Federal rules that apply in West Virginia and every other state
ADA reach ranges
Where vending machines are provided, at least one of each type has to meet the operable parts rules in the 2010 ADA Standards (sections 228.1 and 309). The parts a customer operates, like the screen, card reader and pickup door, have to sit within reach: between 15 and 48 inches above the floor for an unobstructed reach (section 308).
Calorie labeling for food
If you own or operate 20 or more vending machines that sell food, federal rules require calorie information for any item whose Nutrition Facts label the buyer cannot see before buying (21 CFR 101.8). In glass-front machines, packages that show calories on the front in large enough type can meet the rule.
Schools
Machines that sell food to students during the school day may stock only items that meet the USDA's Smart Snacks nutrition standards. The school day runs from midnight until 30 minutes after the official school day ends (7 CFR 210.11).
Setting up the business in West Virginia
- Entity: form an LLC with the Secretary of State. Articles of Organization (Form LLD-1) cost $100, plus $1 if you file online (Secretary of State). After that, every registered business files an annual report with a $25 fee between January 1 and June 30, starting the year after you register. The first registration fee can be waived for veteran-owned businesses and for West Virginia residents age 18 to 29.
- Business franchise tax: none. No tax is due under it for taxable years beginning on or after January 1, 2015 (W. Va. Code 11-23-6).
- City business and occupation tax: the Tax Division says most West Virginia cities rely on a municipal B&O tax measured by gross receipts, with no deduction for the cost of doing business, at rates that vary by city and activity (TSD-100; W. Va. Code 8-13-5). The Tax Division does not collect it.
- Local rules: cities may also charge registration taxes or license fees. The Tax Division tells new businesses to contact each city where they will do business. Do that for every town where you place a machine.

West Virginia vending permit and license FAQ
Do I need a license to put a vending machine in West Virginia?
We found no general state vending machine license. You need a $30 business registration certificate from the Tax Division before you start selling, and it also serves as your sales tax certificate. Add a local health department permit only if a machine sells food that needs temperature control.
Do I need a food permit for a snack vending machine in West Virginia?
Not if the location offers only prepackaged foods that do not need time or temperature control for safety, such as sealed snacks and bottled drinks (64CSR17, sec. 4.3.a). Sandwiches, milk and other refrigerated food need a permit from the local health department, which sets its own fee.
Is vending machine food taxed in West Virginia?
Yes. West Virginia does not tax most grocery food, but food sold through vending machines and soft drinks are taxed at the full 6% under W. Va. Code 11-15-3b, plus 1% in towns with a municipal sales tax. That includes candy and bottled water sold from a machine.
Do I need a license to sell Pokémon cards from a vending machine in West Virginia?
No special license. Trading cards are taxable merchandise, so the business registration certificate covers sales tax. Stock authentic product and keep Pokémon characters and logos off the machine itself.
How much does a West Virginia business registration certificate cost?
$30. The Tax Division issues it, it stays valid until the business closes, moves or changes owners, and it doubles as your sales tax certificate.
Do I pay sales tax on inventory I buy for my vending machines in West Virginia?
Not if you buy it to resell. Give your supplier Form F0003, the Streamlined Sales and Use Tax Certificate of Exemption, marked for resale with your West Virginia registration number. You then collect and send in sales tax when the items sell from your machines. Inventory you use yourself or give away is subject to use tax.
Do I need a separate business registration certificate for each vending machine?
Not for each machine. W. Va. Code 11-12-3 says a separate certificate is not required for each coin-operated machine, but one is required for each location where making coin-operated machines available to the public is itself a business activity. Get the Tax Division's answer in writing for your route, especially if your machines take cards only.
